Dissent within Maoists on the Peace Process (August 28 -September 3)

Immediately being elected prime minister, Baburam Bhattarai stated his three priorities: peace, constitution, and relief to the people. The next day, the legislature-parliament amended the Interim Constitution 2007 of the tenth time, extending the term of the Constituent Assembly by three months. There were no doubts and confusion regarding the extension of the CA term this time.

However, there was dispute regarding cabinet expansion between UCPN (M) and United Democratic Madhesi Front (UDMF). The faction under Vaidya had proposed Narayankaji Shrestha and CP Gajurel as deputy prime ministers with important ministries; however, Dahal faction was not in favour of installing two deputies to the prime minister and including Shrestha in the government. After no agreement could be reached on the precedence and rank after the prime minister, it was left to the chairperson Dahal and vice-presidents Vaidya and Bhattarai to settle the issue.

The expansion of the cabinet got delayed as there was no agreement among the three senior leaders. The UCPN (M) wanted to move the peace process forward after there was no agreement on power-sharing. The meeting of the Standing Committee on August 30 decided to take its own peace proposal forward which it had unveiled earlier with commitment to complete the peace process within 45 days if the government was formed under its leadership.

The next day, the leaders of the UCPN (M), Nepali Congress, and UML met at the prime minister’s residence in Baluwatar. It was agreed in the meeting to hand over the keys of the arms containers in the Maoist cantonments. A meeting of the Army Integration Special Committee (AISC) the same day decided to receive the keys through special teams. A meeting took place at Dahal residence in Naya Bazaar to finalise the handing over of the keys among the chairperson Dahal, vice-chairperson Vaidya, and Prime Minister Bhattarai; however, the Vaidya opposed the proposal. After that, chairperson Dahal discussed the issue with the commanders of all the seven cantonments and instructed them to hand over the keys. Vaidya expressed his opposition in a press release: “I request all concerned to immediately withdraw this suicidal decision”. Chairperson countered, “We request all the party cadres, People’s Liberation Army, and general people to work with patience and determination for official party decision and not be provoked by Kiran (Vaiday)-issued statement and activities against the party policies and decision”.

Vaidya faction enforced chakkajam (transport halt) and took out torch rallies. The meeting of the Standing Committee was boycotted by vice-chairpersons Vaidya, Narayankaji Shrestha, general secretary Ram Bahadur Thapa, secretary CP Gajurel, Dev Gurung, and Netra Bikram Chand. “Handing over the keys is a totally disarmament process, and we can never agree to this in principle,” said Vaidya through a press release. Despite vehement protests from the Vaidya faction, keys to the arms containers of all the seven cantonments were handed over to the special team of the AISC. Nepali Congress and UML termed the development as positive. The resulting dispute within the party has proved that the problems in the peace and constitution-drafting process lies within the UCPN(M), rather than with other parties as they used to allege. The dispute within the UCPN (M) has again raised doubts about the peace process moving ahead smoothly.

Main Developments

August 28 A four-point agreement between UCPN (M) and UDMF. UDMF decides to support UCPN (M).

UCPN (M) vice-chairperson Baburam Bhattarai elected prime minister. Bhattarai got 340 votes and his opponent from Nepali Congress Ram Chandra Paudel got 235; NWPP and RPP-N boycott the elections.

August 29 Prime Minister Baburam Bhattarai takes oath of office and secrecy from the President Ram Baran Yadav. Bijaya Kumar Gachhedar from Forum-Democratic becomes deputy prime minister and home minister.

Meeting of the UCPN (M) Standing Committee. Disagreement on the names of the leaders to be inducted into the government.

Meeting between UCPN (M) Pushpa Kamal Dahal and UDMF leaders on cabinet expansion. UDMF could not forward names for the cabinet.

Meeting of the Legislature-parliament decides to amend the Interim Constitution 2007 by extending the tenure of the Constituent Assembly by three months. RPP-N votes against the proposal.

August 30 Meeting of the UCPN (M) Standing Committee decides to move ahead with the already published proposal on the peace process.

Dispute within UCPN (M) on the names of the ministers. Chairperson Dahal and vice-chairperson Mohan Vaidya and the Prime Minister Bhattarai given the responsibility to settle the issue.

Prime Minister Bhattarai meets Nepali Congress president Koirala and asks him to join the government. Koirala refuses the proposal. Bhattarai proposes the formation of a high-level mechanism.

Meeting of the Nepali Congress officials concludes that the agreement between the UCPN(M) and UDMF will not be able to complete the peace process

August 31 Meeting of the leaders of the three parties in the prime minister’s quarters in Baluwatar to hand over the keys of the arms containers at the Maoist cantonments.

Meeting of the AISC decides to receive the keys through the monitoring team.

Nepali Congress parliamentary leader Ram Chandra Paudel in a press conference states that not more than 5000 Maoist combatants can be integrated.

Meeting of the UDMF to decide on the allocation of ministries. No decision is reached after all the parties vie of the Ministry of Physical Planning.

Prime Minister Bhattarai meets UML chairperson Jhala Nath Khanal and requests help in the peace and constitution-drafting process. Khanal requests him to take all the opposition parties into confidence.

September 1 UCPN (M) decides to hand over the keys of the arms container and the process begins. Vice-chairperson Vaidya opposes the move, says it is a suicidal move in a press release, announces street protests.
September 2 Meeting of the UCPN (M) Standing Committee is boycotted by Vaidya faction over handing over of the keys of the arms containers.

Vaidya faction enforces a chakkajam (transport halt) from 9:30 am to 10:30 am.

UCPN (M) chairperson in a press release asks everyone not to be confused about Vaidya’s comments and says the decision to hand over the keys was as per the party decision.

UCPN (M) vice-chairperson Mohan Vaidya and general secretary Ram Bahadur Thapa issue a press release expressing their opposition over the handing over of the keys of the arms containers and asks that the decision be reversed.

September 3 Meeting of the UCPN (M) Standing Committee to discuss the keys handover issue. Both sides stick to their stance.

Meeting of the Nepali Congress Working Committee. Accusations of president’s weakness in the loss at the prime ministerial election. Concludes that the keys handover as a positive development.

Meeting of the UDMF reaches an agreement over the allocation of ministries.

Meeting of the sub-committee of the Constitutional Committee of the Constituent Assembly discusses on the formation of state restructuring commission or an experts team.
